Terms of use


This portal (uniprofessors.com) aims to determine and increase the quality of teaching at educational institutions in Germany and to promote communication and exchange between students. On uniprofessors.com, students can rate universities, especially lecturers at German universities, and exchange ideas about them. In addition, teachers have the opportunity to present themselves on the portal. Only limited information is available on the portal for non-registered users. All additional functions are only available to registered users and premium users (hereinafter also referred to as members).

1. Validity and change of the terms of use


1.1 The following general terms of use apply between the operator and the user of the offer. By registering as a student or lecturer, the user agrees to all terms.

1.2 The operator reserves the right to change the terms of use at any time. As long as the changes are essentially without disadvantages for the members, there is no obligation on the part of the operator to inform the users about them in advance. This is particularly the case when new services are offered and the conditions have to be expanded accordingly.

1.3 In all cases where a material change is made to the Terms of Use, users will be notified at least 1 week prior to the effective date. The information will be sent by e-mail to the address given during registration.

1.4 Each user has the option to object to the changes within 1 week of receiving the email. After the deadline has expired, the consent is deemed to have been given.

1.5 If the user objects to the validity of the changed terms of use, the operator can terminate the user's membership with immediate effect. In the case of student users, all personal data and reviews submitted by the user are deleted - but not such data that does not lose its relevance without reference to the user, for example recommendations. If a lecturer account is deleted, all personal data linked to the user account will be deleted, but not the lecturer profile or the associated information and evaluations of the courses.

2. Student Membership


2.1 Student membership on uniprofessors.com has two plans, free and premium. Anyone who is enrolled at a German university at the time of enrollment or who completed their studies less than 2 years ago can enroll. A valid and personal e-mail address must be provided when registering. Entering so-called disposable addresses or collective addresses offered by anti-spam services is not permitted.

2.2 In addition to a valid email address, you must register with your valid full name. In particular, these names are not permitted

names of other natural or legal persons,
Names that are copyrighted, trademarked or otherwise infringe the rights of any person or entity, vulgar or otherwise offensive or provocative names are used. It is not permitted to provide false or misleading information or to register under a different identity. The user undertakes that all personal data provided is true.

2.3 Membership on uniprofessors.com is not transferable. Each person may only register once as a student and confirms when registering that they do not already have another user account as a student.

2.4 After registering on the portal, a message is first sent to the specified email address. This message contains a link that must be used to activate the user account. Only then can the account be used.

2.5 Membership can be terminated at any time without giving a reason by a user via their personal profile in the Settings area, which will delete all personal data. Membership can also be terminated by the operator at any time without notice and to the exclusion of any claims for damages, especially in the event of misuse of the account.

3. Teacher Membership


3.1 Membership as a lecturer on uniprofessors.com is also free. Any natural person who is teaching at a German university at the time of registration may register. Use is not limited to private lecturers, but also extends to lecturers without an academic title or to student assistants and tutors. A valid email address must be provided when registering. If you register as a teacher whose name is already on the website, your e-mail should use the official university address of the teacher, otherwise the affiliation to the university must be evident from the address, e.g. B. by the second-level domain otherwise provide a document that proves this.

3.2 When registering, a lecturer must provide an e-mail address, a first and last name, the university for which he works and the courses he teaches. The user undertakes that all personal data provided is true. It is not permitted to provide false or misleading information or to register under a different identity.

3.3 Membership on uniprofessors.com begins with the activation of the account after the confirmation of the registration through a challenge-response procedure. After registering on the portal, a message is first sent to the specified email address. This message contains a link that must be used to activate the user account. Only then can the account be used.

3.4 Membership on uniprofessors.com is not transferable. Each person may only register once as a teacher and confirms when registering that they do not already have another user account as a teacher. A student who is also a teacher can register on uniprofessors.com both as a student and as a lecturer.

3.5 Membership can be terminated by a user at any time via his personal account without giving reasons. The data will be deleted. The profile associated with the account can remain. Membership can also be terminated by the operator at any time without notice and to the exclusion of any claims for damages, especially in the event of misuse of the account.

3.6 Teachers can submit a request to remove the wrong comments about them.

3.7 By uploading your image as a teacher, you consent to us placing our watermark logo on your image and displaying it publicly. You are free to delete your profile pictures at any time.

4. User Obligations


4.1 Each user undertakes to use the operator's offer solely for private purposes or, in the case of lecturers, also for professional purposes. Commercial use of the offer is not permitted.

4.2 Each user is obliged to adhere to the following basic rules when using the offer:Ratings or comments must relate to a specific instructor
Ratings and comments should be as fair and factual as possible
Rumors or statements based on hearsay may not be published
The statements made in the ratings or other comments must be true
The user must have personally attended one of the lecturer's evaluated or commented courses
Only one rating can be given per teacher
The automated or computer-controlled submission of ratings is prohibited
The information provided when creating a lecturer or assigning courses to a lecturer must be correct
It is not permitted to assign the wrong course or university to a teacher
It is not permitted to give multiple ratings or comments to an instructor by creating the same instructor multiple times
Profiles for non-existent, retired faculty, or deceased faculty are not allowed
Ratings or other comments must not contain advertising

4.3 Each user undertakes not to post any illegal content or content that is otherwise inadmissible. This includes in particular:

Offensive or defamatory statements
Defamation, insults, improper abusive criticism, lies or false statements of fact
Threats against instructors, users or third parties
Content that encourages or encourages others to commit illegal acts
Content that is pornographic, glorifies violence, is obscene, racist, vulgar, harmful to young people, immoral, unconstitutional or violates any other applicable law
Content with risks for software and hardware
Links to websites with the above illegal content

4.4 A user is responsible for the confidential handling of access data. He must ensure that the password he has chosen remains secret and that no unauthorized use of the account by third parties can take place.

4.5 If a user becomes aware of misuse of his user data, he must inform the operator immediately. If the operator becomes aware of misuse or if there is a reasonable suspicion, the operator is entitled to exclude the user in question from membership of uniprofessors.com by blocking or deleting it.

5. Content


5.1 A user is solely responsible for all reviews and other disseminated content submitted under their account. The operator is not liable for the correctness, quality or completeness of the content entered by the users. The publication of the ratings written by the participants and other information posted does not constitute an expression of opinion or advice from the operator. The operator merely provides the technical means for publishing the content and does not adopt this as its own, in particular the operator will not take any position on the content of refer to users.

5.2 The operator assures users of anonymity for all ratings submitted for courses.

5.3 By posting ratings and other content, the operator is granted the unlimited right to use this content in terms of time and location. The right of use includes in particular the publication, distribution and provision of the content beyond uniprofessors.com as well as archiving and storage in the operator's databases.

5.4 The operator is entitled, but not obliged, to monitor all content posted or to check it before publication and if missed anything, correct it as soon as getting informed..

5.5 The operator is not obliged to publish the content posted by a user.

5.6 The operator is entitled to edit the content posted by a user. This includes above all the correction of incorrect data, for example in teacher profiles. However, the right does not extend to changing opinions expressed in ratings or other comments - unless the operator has been expressly authorized by the user to edit this content.

5.7 The operator is not responsible for the content of external websites that are referred to by a link from Uniprofessors.com. The content of linked pages is only checked if there is a suspicion of illegal content on the linked page. After becoming aware of illegal content on linked pages, the corresponding references will be removed.

5.8 In the event of illegal actions or content by a user, the operator is entitled to support law enforcement authorities in their investigations, even without checking their legality. Apart from that, no data, in particular not data that could provide conclusions about the identity of a user, will be released to third parties without the express consent of the user - unless the operator is forced to do so by a court or public prosecutor's decision.

5.9 Each user undertakes not to violate any rights of third parties, e.g. in the form of copyright or trademark rights, by posting content.

5.10 Users are not entitled to compensation for posting content.

Teachers's negative comments
5.11.1 We do not display negative comments in public to maintain respect for teachers. Instead, we only make them available to premium users.
5.11.2 Negative comments are flagged by the operators when they feel a comment is bad for a teacher's reputation for public display.
5.11.3 Teachers can request to show a negative comment publicly or to mark a comment as negative at any time. However, the operator makes the final decision on this and there is no obligation on the operators to accept all such requests.

6. Library Uploads


6.1 The resources that the user uploads to the library must be owned by the user. Uploading third party resources is prohibited. The user must have all rights of the resource.

6.2 By uploading a resource to the library, the user agrees that we can sell their resource in uniprofessors.com indefinitely (single sale or via premium access), in return the user receives 1 Month premium account in uniprofessors.com, all this happens only if the resource is verified and activated by the operators.

7. Violation of Terms of Use


7.1 If a user culpably violates these terms of use, the operator is entitled to exclude the user from membership (blocking) or to delete his account. In the case of particularly serious violations, the operator is entitled to take civil and/or criminal action against the user.

7.2 If the operator suffers damage due to a culpable breach of these terms of use or any other illegal action by a user, the operator is entitled to demand compensation from the user for the damage that has occurred.

7.3 In the event of exclusion/blocking, the user's personal data will be stored to the extent that it will also prevent the user's membership in the future.

8. Liability


8.1 Claims, in particular claims for damages, cannot be asserted against the operator because of illegal actions or actions or content that violate these Terms of Use, provided the operator was not aware of them, there are no circumstances that caused the illegal Actions or content should have been obvious to the operator, or the illegal content or content that violated these provisions was removed after the operator became aware of it.

8.2 The operator is not liable for failure to take action if there is only a suspicion of a violation of these terms of use or any other right.

8.3 The operator is only liable for economic, physical or immaterial damage in the event of intent or gross negligence.

8.4 The operator does not guarantee the uninterrupted availability of the offer. He reserves the right to carry out maintenance work or further developments at his own discretion, which may lead to restrictions in the use of the offer.

Severability clause


9 The invalidity of individual clauses of these terms of use does not affect the validity of the remaining provisions. The statutory regulation that comes as close as possible to the meaning and purpose of the provision shall replace the ineffective conditions.

Governing Law and Jurisdiction


10 The law of the Federal Republic of Germany applies. Place of jurisdiction for all legal disputes is Frankfurt am Main.
